Terms of service.

Understudy is operated by [COMPANY LEGAL NAME], [REGISTERED ADDRESS] ("Understudy", "we", "us"). By creating an account or buying credits you agree to these terms. If you do not agree, please do not use the service. Questions go to contact@understudy.my.

You must be at least 18 and able to enter a binding contract. If you use Understudy for a business, you confirm you may accept these terms for it.

Your account

• You sign in with an email address and a one-time code. Keep your inbox and codes private; anyone with your code can reach your account.
• Give accurate details and keep them current. One account per person or business.
• You are responsible for activity under your account. Tell us promptly about unauthorised use.

What Understudy does

Understudy turns a short brief about your business into short social video and images. You choose a template, describe what you want, optionally attach reference images, pick a format, and we generate the result with third-party AI models.

What we do not promise. Generated content comes from statistical models, so:

• results vary between attempts and are not guaranteed to be unique or reproducible;
• text, logos, faces, hands and fine detail may be imperfect, and a logo may not be reproduced exactly;
• we do not promise the output is accurate, complete, suitable for a particular purpose, or cleared for any particular use;
• a provider may reject or fail a request, including through automated moderation;
• generation times vary and are not guaranteed.

You are responsible for reviewing anything before you publish it, and for the claims it makes about your business.

Credits and prices

Creations are paid for with credits. Current prices are in US dollars and exclude any tax that may apply:

You can also buy a one-off top-up of 200 credits for $20. A 5-second Reel costs 35 credits, a 10-second Reel costs 70, and an image costs 5.

• Monthly plan credits are added at the start of each paid period and expire at the end of that period. They do not roll over.
• Top-up credits do not expire.
• New verified accounts may receive 35 free credits, once per person and email address, subject to daily availability. We may change or withdraw this offer.
• Where you hold more than one kind of credit, the app uses the earliest-expiring monthly credits first, then free credits, then purchased credits.
• Prices may change. A change to a plan you already hold takes effect from your next renewal, and we will tell you beforehand.

Subscriptions, renewal and cancellation

• Paid plans renew automatically each month until cancelled, and the payment method on file is charged at renewal.
• You can cancel from the billing controls in your account. Cancellation stops the next renewal and your current allowance stays available until it expires. You can resume before the cancellation takes effect.
• Plan changes take effect at your next renewal unless we tell you otherwise.
• If a renewal payment fails, access to credits may pause until it succeeds. We may retry the payment as Stripe allows.
• We may suspend or end a subscription for breach of these terms, or stop offering a plan. If we end a plan you have paid for and you have not breached these terms, we will refund the unused part of the current period.

Refunds are covered by the refund policy.

Failed creations

If a creation fails or is rejected, the reserved credits are returned automatically and you are not charged again for it. If a request's outcome is genuinely unknown, it can stay pending while we confirm it with the provider; we do not charge twice for the same creation. Contact us rather than repeatedly creating replacements.

Your content, and what you may upload

You keep ownership of the briefs, brand details and images you upload, and of the content we generate for you. You give us permission to store, process and transmit them as needed to run the service, including sending them to the providers listed in the privacy policy.

You confirm that, for everything you upload or ask us to use:

• you own it or have permission to use it, including any logo, trademark or photograph;
• you have the consent of every identifiable person shown, and specifically that you may use their likeness in generated marketing content;
• it does not break anyone's rights or any law.

Do not rely on Understudy to reproduce a trademark exactly, and do not present generated content as a real photograph of a real person, event or endorsement.

Acceptable use

Do not use Understudy to create, upload or publish content that:

• is unlawful, defamatory, harassing, hateful or discriminatory;
• sexualises anyone, or involves anyone under 18;
• impersonates a person or business, or uses someone's likeness without their consent, including to deceive;
• makes false or misleading claims, including fake reviews, fake endorsements or invented offers, prices or qualifications;
• infringes copyright, trade marks or other rights;
• promotes scams, malware, illegal goods or services, or health claims you cannot support;
• attempts to break, overload, scrape or reverse engineer the service, or to avoid credit charges and spending limits.

Report abuse or content that infringes your rights to contact@understudy.my. We may remove content and suspend accounts that break these rules, and we may report unlawful material.

Availability and changes

We aim to keep Understudy available but we do not promise uninterrupted service. Features depend on third-party models and providers and may change, be rate limited, or be withdrawn. We may set technical limits, including daily creation and spending limits, to protect the service and control cost.

Ending your use

You may stop using Understudy at any time and ask us to delete your account. We may suspend or end your access if you breach these terms, if we must for legal reasons, or if your use risks harm to others or to the service. If we end your access without cause, we will refund any unused paid credits.

Our responsibility to you

Understudy is provided "as is". To the extent the law allows, we exclude implied warranties and we are not liable for lost profits, lost business or indirect or consequential loss.

Where we are liable, our total liability for all claims in any twelve-month period is limited to the greater of the amount you paid us in that period and US$100.

Nothing in these terms limits liability that cannot lawfully be limited, including for death or personal injury caused by negligence, or for fraud.

You are responsible for the content you upload and publish, and for any claim arising from it. If a third party claims against us because of your content or your breach of these terms, you agree to cover the reasonable costs of that claim.

General

• These terms, with the privacy policy and refund policy, are the whole agreement between us.
• If a clause is unenforceable, the rest still applies.
• We may update these terms. Material changes take effect from your next renewal or 30 days after we tell you, whichever is later.
• These terms are governed by the laws of [JURISDICTION], and its courts have exclusive jurisdiction, without affecting any right you have to bring a claim where you live.
